Q1. Is patient self-referral for Radiological investigation ( involving ionising radiation ) permitted under the legislation?
A1. Article 14.4 applies - " Where a practitioner accepts a referral from a person who is not a prescriber the practitioner is deemed to be the prescriber and shall comply with the duties of a prescriber. "
Patient self-referral is therefore permissible where a Radiologist ( Practitioner ) is prepared to undertake the additional duties/responsibilities normally undertaken by Prescribers ( referring Doctors and Dentists ), which can obviously be quite considerable.
Q2. Are Medical Personnel operating in Independent Facilities permitted to refer patients to their own Facility for investigations involving ionising radiation where such equipment is available on-site?
A2. This is permissible if the relevant Medical Personnel are working in conjunction with an officially nominated Radiologist/Practitioner who takes clinical responsibility for all investigations involving ionising radiation performed at the Facility.
